Asylum is a form of legal protection for refugees. Refugees are persons with a well-founded fear of returning to their home countries because of persecution. The persecution feared must be on account of race, religion, nationality, political opinion, or membership in a particular social group. Some refer to all asylum generally as “political asylum,” although there are several forms of non-political protection.
The key requirement for asylum that most people aren’t aware of is the 1 year filing deadline. Asylum applications must be filed within a year of your last entry to the United States. There are, however, exceptions to this rule.
If you win asylum, in one year you are eligible for a green card.
Temporary Protected Status (TPS) is a form of temporary relief from deportation for people from designated countries who have been residing in the United States before a specified date.
In our practice, we have helped obtain and maintain TPS for citizens of El Salvador, Honduras, Nepal, Liberia, Syria, and Haiti. The rules for getting and keeping TPS are different for each country, and there are several recent changes to be aware of.
